WARRANTY COVERAGE
EDCO ArrowLine Shakes and/or Slate is warranted to you, the original property owner(s), by the manufacturer EDCO Products, Inc. (EDCO). EDCO warrants against the product containing manufacturing defects which result in cracking, chipping, flaking, peeling, as well as, manufacturing defects which cause perforation or deterioration of the steel substrate due to rust or hail. The product will also not burn or support combustion. Additionally, EDCO further warrants the product, after removal of foreign surface deposits, will not fade or change color in excess of 5 NBS (Hunter) units as a result of natural weathering or ultraviolet exposure for a period of 30 years from the date of installation. Color measurements are to be made per ASTM D-2244. Additionally, EDCO warrants that the product will not chalk in excess of a number 8 rating when measured per ASTM D-4214, Method A, for a period of 30 years. This warranty remains in effect for as long as the original property owner(s) are living and are the owner(s) of the property which the product was applied to. In the event there is more than one original property owner, the warranty will remain in effect as long as one of the original property owners is living and owns a significant interest in the property to which the product was applied. Because this warranty was created to cover the product of individual property owner(s) for the property owner’s lifetime (human beings), this warranty, understandably, does not cover product applied to property owned in whole or part by corporations, governmental entities or agencies, religious organizations, trusts, condominium or cooperative housing arrangements, intangible legal entities or any other entity organization capable of an infinite life. For such intangible entities capable of an infinite life, the duration of the warranty is 50 years from the date of the original installation and is nontransferable. This warranty shall be valid only after the registration certificate is completely filled in by the original property owner(s), signed and mailed to EDCO Products, Inc. via registered mail within 30 days after completion of installation of the product or purchase from the builder of your newly constructed home. All warranties are subject to the conditions, remedies, transfer requirements, limitations, and legal rights stated in this certificate.
CLAIMS PROCEDURE
If you think your product shows manufacturing defects, simply notify EDCO Products, Inc. Hopkins, MN 55343, Attention: Warranty Services by registered mail, include the date the product was originally installed, certificate number, and name exactly as indicated on the original warranty registration. If you choose to exercise your rights under this warranty, do not begin any repairs prior to writing EDCO and receiving its permission to do so. Some unauthorized methods of remedy may ruin the product, making it impossible to repair. Further, EDCO must have a reasonable opportunity to inspect the product for defects before repairs are begun.
REMEDIES
If your product shows manufacturing defects, EDCO, at its option, will either repair, refinish, or replace the defective product upon receipt of a $100 USD service payment by the property owner(s) for each incident under the warranty. EDCO may also elect to refund the purchase price of the originally installed products found to be defective. EDCO’s total liability for a claim under this warranty shall be limited to and in no event exceed, the total purchase price, including labor and taxes, of the installed product. Any costs and expenses beyond EDCO’s liability shall be paid to EDCO or otherwise paid by the owner(s) prior to EDCO commencing warranty work on any claim which exceeds EDCO’s total liability. The original warranty period shall not be extended by any such work performed, but the remaining warranty time period shall continue in effect and be applicable under the terms and conditions of this warranty to the warranty work done.
CONDITIONS
EDCO reserves the right to discontinue or make changes to its products. If your product is not available and EDCO decides to replace the defective product, EDCO shall have the right to substitute product which it considers of equal quality and value. A color variance may occur between any new replacement product in comparison to the originally installed product due to normal weathering exposure and would not be indicative of defective product. All warranty claims shall be settled between you and EDCO, but EDCO may direct and pay a company, dealer, contractor, applicator or distributor to perform any remedy under this warranty on EDCO’s behalf.
TRANSFER OF WARRANTY AND PRORATION
This warranty is transferable by the original property owner(s) to the next owner(s) of the property to which the product is attached provided EDCO receives notice of the transfer of title of the property, accompanied by a $100 USD transfer fee, within 30 days of the date of transfer of ownership. Your notice must be received via registered mail and include the original owner(s) name(s), as registered with EDCO on the original warranty registration, the name(s) of the next property owner(s), the certificate registration number and the date the product was installed. Failure to file the required transfer notice within 30 days shall relieve EDCO of any further obligation to the next owner(s) under the terms of the warranty. This warranty can be transferred to additional subsequent owners if the notice of transfer procedures, as listed above, are followed. Upon transfer, all warranty periods shall be prorated from the date of the original product installation as follows: first through the tenth year EDCO pays 100% of the costs of labor and material to refinish, repair or replace defective products. During the eleventh year after installation, the homeowner(s) will pay 50% of the costs and EDCO will pay the balance. The twelfth through the twentieth year the homeowner(s) will pay an additional 5% per year and EDCO will pay the balance. The twenty-first through the fiftieth year EDCO’s liability will be 5% with the homeowner(s) paying the balance. This section does not apply to entities capable of an infinite life.
LIMITATIONS
This warranty is not applicable to recreational vehicles including, but limited to campers and motor homes. This warranty is not applicable if the product installed on a roof with less than a 4 in 12 slope. EDCO does not warrant against and shall not be liable for any damages to the product due to any of the following causes: faulty or improper installation or application of the product or other related products such as underlayment and flashings by others, use of accessories that do not properly receive or secure the product, settlement, shrinkage, distortion, warping, failure or cracking of the roof or materials t6 which the product is applied, earthquake, hurricane, tornado, cyclone, gale, lightning, fire, acts of God, flood, wind-borne objects, ice or weather of catastrophic nature is defined by the United States Weather Bureau, harmful chemicals, surface discoloration due to air pollution, normal weathering of surface, fumes, vapors or salt spray directly applied to the product or in the atmosphere, vandalism, misuse, physical abuse, riot, insurrection or civil disorder, negligence in or failure to provide reasonable and necessary maintenance of the product to prevent an accumulation of surface dirt, staining or mildew. EDCO cannot and shall not be liable to you for breach of any other written or oral express warranties, such as those if any, given to you by dealers, contractors, applicators or distributors of the product. Any implied warranties imposed by law, such as the implied warranties of merchantability and fitness for purpose, are limited to the duration of this express warranty. EDCO shall not be liable to you for any consequential damages or incidental damages for breach of any express, written, oral or implied warranty on the product. Your exclusive remedy shall be repair, refinish or replacement solely at EDCO’s option, only on the terms stated in this certificate.
LEGAL RIGHTS
Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply to you. Some jurisdictions do not allow the exclusion or limitation on incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific rights, and you may also have other rights, which may vary from province to province.
